Please read these Terms of Use ("Terms") carefully before using Haven ("the app"). By downloading, installing, or using Haven, you agree to be bound by these Terms. If you do not agree, do not use the app.

Haven is developed and operated by Ben Bates ("we", "us", "our"), based in George Town, Cayman Islands.

1. What Haven is

Haven is a personal safety communication tool. It allows you to send a discreet alert to a trusted contact you have chosen if you feel unsafe or at risk. The alert may include your display name, GPS location (when available), and an optional audio recording.

Haven is designed to complement, not replace, emergency services. It is a person-to-person communication tool that helps you reach someone you trust quickly and quietly.

2. What Haven is not

Haven is not an emergency service. It does not connect you to police, ambulance, fire services, or any government emergency response system. It does not monitor your location continuously. It does not guarantee that your alert will be received, read, or acted upon by your trusted contact.

If you are in immediate danger, always contact your local emergency services first (911 in the Cayman Islands and United States, 999 in the United Kingdom, or your local equivalent).

Haven should be considered one layer of protection alongside, not instead of, established emergency services and personal safety practices.

3. Eligibility

Haven is available to anyone aged 13 or older. Users under 18 should have Haven set up by a parent or guardian, who is responsible for choosing appropriate trusted contacts and configuring the app on the young person's behalf.

By using Haven, you confirm that you are at least 13 years old, or that a parent or guardian has set up the app on your behalf and consents to these Terms.

4. Your account and responsibilities

When you set up Haven, you provide a display name, phone number, and at least one trusted contact. You are responsible for:

Providing accurate information during setup. Your display name and phone number are used to identify you to your trusted contacts. Inaccurate information may prevent alerts from being delivered or cause confusion for recipients.

Keeping your trusted contacts up to date. Haven sends alerts only to the contacts you have designated. If your trusted contact changes their phone number, removes Haven, or is otherwise unreachable, you are responsible for updating your contact list.

Using Haven in good faith. Haven is intended for genuine personal safety purposes. You agree not to use Haven to send false, malicious, or harassing alerts, or to use the app in any way that could cause harm, distress, or inconvenience to others.

Maintaining your device. Haven relies on your device having a working internet connection, sufficient battery, and the necessary permissions (notifications, location, microphone if opted in) to function correctly. You are responsible for ensuring your device is capable of sending and receiving alerts.

5. Alert delivery

Haven uses multiple systems to deliver alerts, including Apple's CloudKit service, Apple's Push Notification service (APNs), and a dedicated push notification server. While we have designed Haven with multiple redundant delivery paths to maximise reliability, we cannot guarantee that every alert will be delivered successfully or delivered within any specific timeframe.

If an alert cannot be delivered through the primary channel, Haven includes fallback mechanisms (including WhatsApp, SMS, and email) that may require manual action from the sender.

You acknowledge that no alert delivery system can guarantee 100% reliability, and that Haven's effectiveness depends on factors including network conditions, device settings, and the availability of your trusted contact.

6. Location and audio data

When you send an alert with the app open and location permissions enabled, your device's GPS coordinates at the time of the alert are included. Location accuracy depends on your device's GPS hardware, satellite visibility, and environmental conditions. Haven does not guarantee the accuracy of location data.

If you have opted in to audio recording, a short audio clip is captured from your device's microphone after an alert is sent and delivered to your trusted contact. You are responsible for ensuring that audio recording complies with the laws of your jurisdiction. Some jurisdictions require the consent of all parties being recorded. By enabling audio recording, you represent that you have considered the legal implications in your location.

You may disable location access and audio recording at any time through your device's Settings or within the Haven app.

7. Institutional use

Haven may be used in conjunction with an institution such as a school, university, or care provider. When institutional alerting is enabled, your alerts are sent to the institution's designated security or safeguarding contact in addition to your personal trusted contact.

Institutional alerting is optional and must be explicitly enabled by you (or by a parent or guardian on behalf of a minor). It is not activated by default.

The institution is responsible for how it handles, stores, and responds to alerts received by its staff. Haven is not responsible for the actions, response times, or data handling practices of any institution.

8. Intellectual property

Haven, including its design, code, branding, icons, and content, is the intellectual property of Ben Bates. All rights are reserved.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use Haven on your personal device for its intended purpose. You may not:

9. Disclaimer of warranties

Haven is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Haven will be uninterrupted, error-free, or free of harmful components. We do not warrant that alerts will be delivered successfully, that location data will be accurate, or that the app will function correctly in all circumstances.

You use Haven at your own risk. No advice or information, whether oral or written, obtained from us or through the app, creates any warranty not expressly stated in these Terms.

10. Limitation of liability

To the fullest extent permitted by applicable law, Ben Bates and any affiliates, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

In no event shall our total liability to you for all claims arising from or related to your use of Haven exceed the amount you have paid to use the app in the twelve months preceding the claim, or ten US dollars (USD $10), whichever is greater.

This limitation applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, or strict liability.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

You agree to indemnify and hold harmless Ben Bates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

12. Modifications to the app and terms

We reserve the right to modify, suspend, or discontinue Haven (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the app.

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top. Continued use of Haven after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, stop using the app.

13. Termination

You may stop using Haven at any time by deleting the app from your device. This removes all locally stored data.

We may suspend or terminate your access to Haven at any time, for any reason, without notice or liability. Reasons for termination may include misuse of the app, sending false alerts, or any conduct we reasonably determine to be harmful to other users or to the integrity of the service.

Upon termination, your licence to use Haven is revoked. Sections 9, 10, 11, and 14 survive termination.

14. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Cayman Islands, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or your use of Haven shall be resolved exclusively in the courts of the Cayman Islands. You consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire agreement

These Terms, together with the Haven Privacy Policy, constitute the entire agreement between you and Ben Bates regarding your use of Haven. They supersede any prior agreements or communications on this subject.
